Welcome to Nearby Secrets. These Terms of Use ("Terms") govern your access to and use of the Nearby Secrets mobile application ("App"), operated by Nearby Secrets ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
These Terms supplement, and do not replace, Apple's Licensed Application End User License Agreement (Standard EULA). In the event of a conflict between these Terms and Apple's Standard EULA, Apple's Standard EULA shall prevail to the extent of the conflict.
You must be at least 18 years old to create an account and use Nearby Secrets. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. We reserve the right to request age verification at any time and to terminate accounts that do not meet this requirement.
When you create an account, you are assigned a unique private identifier in the format SIR-XXX-XXX ("SIR ID"). You may register using Apple Sign In, Google Sign In, or email and password. You are responsible for maintaining the confidentiality of your account credentials. Each person may maintain only one account. You agree to notify us immediately of any unauthorized use of your account.
Nearby Secrets allows you to post text-based content, comments, and direct messages ("User Content"). You retain ownership of your User Content. By posting User Content, you grant Nearby Secrets a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the App.
You are solely responsible for your User Content. You agree not to post content that:

Nearby Secrets offers direct messaging with the following security measures:
All conduct rules set forth in Section 3 apply equally to direct messages. Content that does not pass safety checks may be withheld from delivery.
We employ automated content filtering systems and rely on user reports to maintain a safe community. We reserve the right, at our sole discretion, to:
Moderation decisions are based on the severity and frequency of violations. If your account is suspended or terminated, you may submit an appeal by contacting us at support@nearbysecrets.app. Appeals will be reviewed within a reasonable timeframe, and you will be notified of the outcome.

Subscription prices are displayed in the App and may vary by region. All purchases are processed by Apple. Refund requests must be directed to Apple in accordance with their refund policies. Nearby Secrets does not process payments directly and cannot issue refunds.
With your permission, the App uses your location to provide location-based features, including the nearby feed and Hot Zones. Your exact location is never displayed publicly to other users. You may enable or disable location services at any time through your device settings. For more information on how we handle location data, please refer to our Privacy Policy.
The App, including its design, features, logos, and all associated content (excluding User Content), is the property of Nearby Secrets and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent.
The App is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Nearby Secrets is not responsible for any User Content posted by users. Use of the App is at your sole risk.
To the maximum extent permitted by applicable law, Nearby Secrets and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App, regardless of the theory of liability.
You agree to indemnify, defend, and hold harmless Nearby Secrets and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the App; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any rights of a third party.
You may delete your account at any time from within the App. Account deletion is immediate and permanent; all associated data will be removed in accordance with our Privacy Policy, except where retention is required by applicable law. We may suspend or terminate your account at our sole discretion if we determine that you have violated these Terms or if your continued use poses a risk to the community or the App.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Nearby Secrets operates, without regard to its conflict of law provisions.
We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the App following the posting of revised Terms constitutes your acceptance of such changes. We encourage you to review these Terms periodically.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy and Apple's Standard EULA, constitute the entire agreement between you and Nearby Secrets regarding your use of the App.
